Acceptance of Terms
By accessing or using eloball.com (the "Site"), including the /elo page and any related tools, data, predictions, or analytics, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Site.
1. Nature of the Content – Informational and Analytical Purposes Only
All content on the Site, including but not limited to Elo ratings, Talent Elo decompositions, matchup predictors, stream scores, market divergence signals, pitcher streaming recommendations, bullpen fatigue metrics, injury watches, velocity analysis, stat projections, and any other data, statistics, or insights (collectively, the "Content"), is provided solely for informational, educational, and demonstration purposes.
The Content represents one analytical methodology and is not:
- Professional advice of any kind
- A guarantee of accuracy, completeness, or future results
- An inducement or recommendation to bet, wager, gamble, enter fantasy contests, make financial decisions, or take any action
2. No Gambling, Betting, Fantasy Sports, Investment, or Financial Advice
We do not offer, facilitate, or endorse gambling, sports betting, daily fantasy sports (DFS), or any form of wagering. The Site does not constitute gambling advice, betting tips, or a prediction service intended to influence real-money decisions.
Nothing on the Site is intended as, nor should it be construed as:
- Investment, financial, tax, or legal advice
- A recommendation to buy, sell, hold, or wager on any asset, outcome, player, team, or market
Any use of the Content for betting, DFS lineups, fantasy drafts, or financial decisions is done entirely at your own risk.
3. No Warranties – Use at Your Own Risk
The Site and Content are provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, non-infringement, or that the Site will be uninterrupted, error-free, secure, or free of viruses.
We make reasonable efforts to provide accurate data but do not guarantee the correctness, reliability, or suitability of any Elo calculations, projections, market comparisons (including Kalshi data), or other metrics. Errors, omissions, delays, or changes in underlying data sources may occur.
4. Limitation of Liability
To the fullest extent permitted by law, the Site owner, operators, contributors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages (including, without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses) arising out of or in connection with:
- Your access to, use of, or inability to use the Site or Content
- Any reliance on the Content (including predictions, ratings, signals, or recommendations)
- Any losses (financial or otherwise) from fantasy sports, betting, DFS, investments, or other decisions
- Technical issues, data inaccuracies, third-party data sources, or external market changes
Even if advised of the possibility of such damages, in no event shall our total liability exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.
5. Indemnification
You agree to indemnify, defend, and hold harmless the Site owner and affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, violation of these Terms, or any third-party claims related to your actions based on the Content.
6. Changes to Terms
We may update these Terms at any time. Continued use after changes constitutes acceptance. Prior to paid subscription launch, we expect to include a binding arbitration clause and class-action waiver common in U.S. SaaS terms.
7. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
